Jonathan N. Auerbach
Law Practice
Jonathan Auerbach is a partner, lawyer, patent agent and trademark agent in the Intellectual Property Group of Stikeman Elliott's Montréal office. Mr. Auerbach has a broad range of experience in all aspects of intellectual property including litigation, prosecution, licensing and counseling, with a particular emphasis on patents, trademarks and copyrights.

Mr. Auerbach also has extensive experience in the acquisition, clearance, prosecution, enforcement and licensing of trademarks including representing clients in trademark opposition proceedings and Section 45 expungement proceedings. He also advises clients on Internet-related aspects of trademark and copyright law including representing clients in domain name disputes.

Mr. Auerbach's litigation practice focuses on intellectual property infringement matters, enforcing against acts involving counterfeit products, the invalidation of intellectual property, registrations and intellectual property contract dispute matters.

Mr. Auerbach also practices intellectual property relating to business law including the management and commercialization of intellectual property and the identification of intellectual property issues in corporate transactions. In this regard, Mr. Auerbach is routinely called upon to manage IP due diligence investigations and to review and analyze commercial agreements that relate to IP and information technology. Mr. Auerbach also prepares, negotiates and advises on licence agreements, sponsorship agreements, merchandising agreements, distributions agreements and sales agreements as they pertain to intellectual property, information technology, software, e-commerce and related matters.

Mr. Auerbach has been recognized in The Legal 500 Canada 2015 in the Technology, Media and Telecoms sectors and in the World Trademark Review's 2017 and 2016 editions The World's Leading Trademark Professionals and in the Leaders League 2016 for patent litigation.

Professional Activities
Mr. Auerbach is a member of the Canadian Bar Association, the American Bar Association, the Law Society of Upper Canada (Ontario) and the Barreau du Québec.

He is also a member of the Intellectual Property Institute of Canada where he is Chair of the Internet Committee as well as on the Intellectual Property Litigation Committee and the Anti-Counterfeiting Committee.

Mr. Auerbach also sits on the Patent Law Committee of the American Intellectual Property Law Association (AIPLA), and is a member of the International Trade-mark Association (INTA), the International Federation of Intellectual Property Attorneys (FICPI) as well as the International Association for the Protection of Intellectual Property (AIPPI). Mr. Auerbach also sits on the Montréal's office Finance Committee.

Prior to attending law school, he earned a Bachelor of Science degree in Anatomy and Cell Biology from McGill University (BSc, 1996) .
